All works will be carried out to the agreed specification between Ornamental & Orchard and the client.
If the client later decides to change the agreed specification of the works Ornamental & Orchard reserve the right to alter the price of the works accordingly. And if required the agreed date the works are to take place.
If Ornamental & Orchard feel it necessary for whatever reason to deviate from the agreed specification of the works, then the new specification will be discussed and agreed with the client prior to the deviated works occurring.
If debris must be taken through a building due to access issues, then Ornamental & Orchard will not accept any liability for damage to floors, walls, doors, door frames or any items within the building. It is the responsibility of the client to provide and install adequate protective coverings and move any items which may be damaged during the works.
Ornamental & Orchard will move any garden furniture or ornaments which impede the works; however Ornamental & Orchard do not take any responsibility for damage caused to such items whilst being moved.
Whilst we take the utmost care Ornamental & Orchard will not take responsibility for damage caused to plants in borders underneath or in the immediate vicinity of the work area.
If an active bird nest (one containing eggs or chicks) is found in the work zone all works will cease until the young have left the nest (usually up to 6 weeks). In this case Ornamental & Orchard will leave the work site safe and tidy until we return to complete the works.
If there are any TPO’s (Tree Preservation Orders) or the works are within a Conservation Area then an application must be made to the local authority for any works on trees over 70mm in diameter at breast height (DBH). Ornamental & Orchard reserve the right to charge for applications made by Ornamental & Orchard on behalf of the client to local authorities in these instances. The client may also make these applications themselves, in this instance Ornamental & Orchard would require a copy of the agreed works application from the local authority before works commence.
Once works have been completed to the agreed specification, payment must be made within five working days of receipt of invoice.
